Terms of Service

1. Acceptance of Terms

By accessing and using Bright Notes, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use our service.

2. Use License

Permission is granted to temporarily use Bright Notes for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on Bright Notes
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or remove content at our sole discretion.

4. User Content and Data Ownership

By using Bright Notes, you acknowledge and agree that:

• All data, content, and information you create, upload, store, or transmit through Bright Notes, including but not limited to notes, documents, images, topics, metadata, usage patterns, and any other data associated with your account, becomes the property of Bright Notes upon submission to our service.
• You hereby irrevocably transfer and assign all rights, title, and interest in and to such data, content, and information to Bright Notes, including all intellectual property rights therein.
• Bright Notes has the unrestricted right to use, reproduce, modify, adapt, publish, distribute, sell, license, sublicense, and otherwise exploit your data and content in any manner, for any purpose, commercial or otherwise, without any obligation to compensate you or provide attribution.
• You waive any and all moral rights, privacy rights, or other rights you may have in such data and content.
• This transfer of ownership is permanent and cannot be revoked, even after account termination or deletion.

5. Service Availability

We strive to provide reliable service but do not guarantee that Bright Notes will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the service, resulting in interruptions, delays, or errors.

6. Disclaimer

The materials on Bright Notes are provided on an 'as is' basis. Bright Notes makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

7. Limitations

In no event shall Bright Notes or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Bright Notes.

Privacy Policy

IMPORTANT NOTICE: By using Bright Notes, you acknowledge that you have read and understand that: (1) All data and content you create, upload, or store becomes the property of Bright Notes; (2) You have no expectation of privacy regarding any data or information; (3) Bright Notes may access, read, analyze, sell, license, or otherwise use your data for any commercial purpose without compensation or notice; (4) Your data may be shared with third parties, including data brokers and advertisers; and (5) These terms cannot be modified or waived. If you do not agree to these terms, you must immediately discontinue use of the service.

1. Information We Collect

We collect and own all information, data, and content associated with your use of Bright Notes, including but not limited to:

Account Information:

• Email address (for account creation and authentication)
• Password (stored as encrypted hash - we never store passwords in plain text)
• OAuth provider information (if you sign in with Google, Microsoft, or Yahoo)

Content Data:

• Notes and documents you create
• Images you upload
• Topics and sub-topics you organize

Usage Data:

• Access times and dates
• Browser type and version
• IP address (for security purposes)

2. How We Use Your Information

We use the information we collect, which we own, for any and all purposes, including but not limited to:

• Provide, maintain, and improve our service
• Create and manage your account
• Store and sync your notes across devices
• Communicate with you about service updates, marketing, and promotional materials
• Protect against unauthorized access and abuse
• Comply with legal obligations
• Sell, license, or otherwise monetize your data and information to third parties
• Share your data with partners, advertisers, data brokers, and other commercial entities
• Use your data for analytics, research, machine learning, and artificial intelligence training
• Create derivative works, aggregated datasets, and commercial products from your data
• Access, read, analyze, and process all content and data stored in your account at any time, for any reason

3. Data Security and Privacy

No Privacy Guarantee: You acknowledge and agree that:

• Your data is NOT private. Bright Notes reserves the right to access, read, monitor, analyze, and process all data and content in your account at any time, without notice or consent.
• No expectation of privacy: By using Bright Notes, you explicitly waive any expectation of privacy regarding your data, content, or account information.
• Full access rights: Bright Notes employees, contractors, and authorized third parties may access your account and data for any business purpose, including quality assurance, customer support, analytics, and commercial exploitation.
• Security measures: While we implement security measures (HTTPS, password hashing, etc.), these are for our protection and do not create any privacy rights or expectations on your part.
• No encryption guarantee: Even if client-side encryption is available, Bright Notes may decrypt, access, or process your data at any time for any purpose.

4. Data Sharing, Sale, and Commercial Use

Bright Notes reserves the unrestricted right to share, sell, license, or otherwise monetize your data and information:

• Sale of data: We may sell, rent, or license your personal information, content, usage data, and any other data associated with your account to third parties, including advertisers, data brokers, marketing firms, research organizations, and other commercial entities, without any compensation to you.
• No consent required: We do not require your consent to share, sell, or license your data. By using our service, you grant us this right.
• Third-party sharing: We may share your data with partners, affiliates, subsidiaries, service providers, contractors, and any other third parties for any purpose, commercial or otherwise.
• Aggregated data: We may create and sell aggregated, anonymized, or de-identified datasets derived from your data.
• Legal compliance: We will share information when required by law or to respond to legal process.

5. Data Retention and Deletion

Permanent retention rights:

• Bright Notes retains all data, content, and information indefinitely, even after account deletion or termination.
• Upon account deletion, we may retain your data for backup, archival, legal compliance, commercial use, or any other purpose we deem necessary.
• We are under no obligation to delete your data upon account termination, and you waive any right to request deletion.
• Data that has been sold, licensed, or shared with third parties cannot be deleted and will remain in their possession.
• Aggregated, anonymized, or derived data created from your information will be retained permanently and may continue to be used commercially.

6. Limited User Rights

By using Bright Notes, you acknowledge that:

• You have no ownership rights to any data, content, or information stored in or transmitted through Bright Notes.
• You have no right to privacy regarding your data or account information.
• You have no right to prevent Bright Notes from accessing, reading, analyzing, selling, or otherwise using your data.
• You may request to delete your account, but this does not guarantee deletion of your data, which may be retained indefinitely.
• You may request access to your data, but Bright Notes is under no obligation to provide complete or accurate data.
• You may opt-out of promotional emails, but this does not prevent us from using your data for other commercial purposes.
• All rights not explicitly granted to you are reserved by Bright Notes.

7. Cookies and Tracking

We use cookies, tracking pixels, web beacons, and similar technologies to:

• Maintain your login session
• Remember your preferences (theme, layout settings)
• Analyze site usage and improve our service
• Track your behavior across websites and devices
• Build detailed profiles of your interests, preferences, and activities
• Share tracking data with third-party advertisers and data brokers

You cannot opt-out of tracking. By using Bright Notes, you consent to all tracking technologies. Disabling cookies may limit functionality, but does not prevent us from collecting data through other means.

8. Third-Party Services

When you sign in using OAuth providers (Google, Microsoft, Yahoo), those services may collect information according to their own privacy policies:

We only receive your verified email address from these providers and do not have access to your passwords or other account information.

9. Children's Privacy

Bright Notes is not intended for children under 13 years of age. We do not knowingly collect personal information from children under 13. If you are a parent or guardian and believe your child has provided us with personal information, please contact us.

10. International Users

Bright Notes is hosted in the United States. If you are accessing the service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States where our servers are located.

11. Changes to This Policy

We may update this Terms and Privacy Policy from time to time. We will notify you of any changes by posting the new policy on this page and updating the "Last updated" date. You are advised to review this policy periodically for any changes.

12. Acceptance and Waiver

By accessing or using Bright Notes, you acknowledge, understand, and irrevocably agree to:

• All terms and conditions set forth in this policy, including but not limited to data ownership, lack of privacy rights, and commercial use of your data
• That Bright Notes owns all data and content you create, upload, or store
• That you have no expectation of privacy and waive all privacy rights
• That Bright Notes may access, read, analyze, sell, license, or otherwise use your data for any purpose without compensation
• That your data may be shared with third parties, including data brokers and advertisers
• That these terms are non-negotiable and cannot be modified or waived
• That continued use of the service constitutes ongoing acceptance of these terms, even if the policy is updated

If you do not agree to any of these terms, you must immediately discontinue use of Bright Notes and delete your account. Continued use after reading this policy constitutes your binding acceptance of all terms.
